Can you sleep in a garden room in Ireland?

The short answer

Not in an exempt garden room. The garden room exemption rules out human habitation, and councils treat sleeping as habitation. For a garden bedroom you need either the new Class 3A garden home exemption (32 to 45 m², strict conditions) or planning permission.

What the rules say

A garden room built without planning permission relies on the Class 3 exemption. One of its conditions is that the building is not used for human habitation, only for purposes connected with enjoying the house. An office, gym or hobby room qualifies. A bedroom doesn't.

This applies however well the room is built. A fully insulated garden room with heating and a toilet is still a Class 3 building if that's how it was built, and still can't be slept in.

Guests, sofa beds and teenagers

This is where most questions come from. A few points help:

  • The use matters, not the furniture. A sofa in a garden office is fine. Regularly sleeping there is a change of use.
  • Councils have taken a firm line. Where garden rooms have been granted permission, councils have attached conditions restricting their use for guest or sleeping accommodation.
  • A teenage den is fine by day. A teenager's bedroom is habitation.

Your options for a bedroom

RouteSizeWhat's involved
Class 3A garden home32 to 45 m²No planning application, but strict conditions, Building Regulations and a council notification. Deadline 31 December 2030.
Planning permissionAnyA full application. Councils often attach conditions tying use to the main house.
Extension to the houseUp to 45 m² exemptA rear extension is exempt up to 45 m² since July 2026, subject to its own conditions.

If it will be slept in

Whichever route you take, a room for sleeping needs more than an office:

  • Fire safety: smoke and heat detection, and an escape route.
  • Ventilation to prevent condensation, which builds up quickly overnight in a small timber room.
  • Year-round heating and insulation to house standards.
  • A toilet nearby, which adds plumbing and drainage costs. See garden rooms with a toilet.

Common questions

Can I put a sofa bed in my garden office?

Having a sofa bed in the room is not itself a breach, but using the room as sleeping accommodation is. Councils have treated guest and sleeping use as habitation, which the garden room exemption rules out. If overnight stays are part of the plan, look at Class 3A or planning permission.

Can my teenager sleep in the garden room?

Not under the garden room exemption. A games room or den during the day is fine. A bedroom is a habitable use, which needs Class 3A (32 to 45 m²) or planning permission.

What happens if I sleep in a garden room without permission?

Using an exempt building for habitation means it is no longer exempt, so it becomes unauthorised development. A neighbour complaint can lead to a council enforcement notice, and it can also cause problems with insurance and when you sell the house.

Can I get planning permission for a bedroom in a garden room?

Yes, you can apply. Councils sometimes grant permission with a condition that the room is used only as part of the main house, not as a separate dwelling. Outcomes vary by council and site.
